· Items admitted conditionally – items whose importation into the country is allowed with the term if a document issued by the relevant authorities of the exporting country is presented.

The designated operator of the UNITED STATES OF AMERICA, the United States Postal Service (USPS), wishes to inform the designated operators of other Union member countries of a change in national legislation relating to the mailability of electronic nicotine delivery systems. From 21 October 2021, electronic nicotine delivery systems are prohibited in all inbound and outbound international items. An “electronic nicotine delivery system” is defined as any electronic device that, through an aerosolized solution, delivers nicotine, flavour or any other substance to the user inhaling from the device. Examples include e-cigarettes, e-hookahs, e-cigars, vape pens, advanced refillable personal vaporizers and electronic pipes. Also prohibited is any component, liquid, part or accessory of an electronic nicotine delivery system, regardless of whether it is sold separately from the device. Despite the terminology, the prohibition applies regardless of whether an item actually contains or is used to deliver nicotine. Details of goods subject to prohibitions and restrictions in the United States can be found in the UPU Prohibitions Compendium (prohibitions.ptc.post) and in the countryspecific list of prohibitions (www.upu.int/en/Postal-Solutions/Programmes-Services/ Postal-Supply-Chain/Customs), in accordance with article 19.1.3 of the UPU Convention. Non-mailable electronic nicotine delivery systems are subject to seizure and forfeiture, and senders of electronic nicotine delivery systems are subject to criminal penalties under US law. The USPS mailing standards, which include definitions of these products, may be accessed via the following link: www.federalregister.gov/ documents/2021/10/21/2021-22787/treatment-of-e-cigarettes-in-the-mail. USPS requests that designated operators take steps to avoid accepting international postal items destined for the US that contain electronic nicotine delivery systems, and that designated operators remind their customers that these articles are prohibited in shipments to the US.
