Part II:
Conditions of admission of articles imported or in transit
2.1 Animals and animal products
2.1.1 Bees, honey and apiary products
Bees, intended for research and exchanged between officially recognized institutions, must be inspected by the veterinary service.
Silkworms, parasites and predators of dangerous insects intended for research and exchanged between officially recognized institutions, must be inspected by the quarantine service.Depending on the decision of the inspectors, the postal items are delivered to the addressees, returned to sender or destroyed.
As article 4 of the Law of 17 July 1997, 468/97–BP, on "State regulation of the import of agricultural products" has been amended, as of 5 May 1999, it has been permitted to send food products,packed by the manufacturer, in international postal items, including EMS items, to the address of a natural person in Ukraine, up to a maximum weight of 10 kilogrammes.
2.1.2 Leeches Leeches must be enclosed with marsh soil or moss in a canvas bag carefu lly sealed and placed in a second container (wooden box or basked) packed with hay orstray.
2.1.3 Products of animal origin intended for consumption by humans or by pet animals
2.2 Plants and plant products
2.2.1 Edible vegetables, plants, grasses, roots and tubers
2.2.2 Fruit and citrus fruit
The import of animal and fish products may be permitted by the State Veterinary Inspection Service of the Ukraine Ministry of Agriculture and Food.
The State Emergency Antiepizootic Commission, under the Cabinet of Ministers of Ukraine, has prohibited as from 30 March 2001 the importation into Ukraine of raw materials, products andfinished foodstuffs of animal origin contained in postal items
The import of seed potatoes, grasses and other plants intended for propagation may be permitted by the Ukraine Ministry of Agriculture and Food and must be accompanied by a phytosanitarycertificate.
The import of fresh fruit and citrus fruit into Ukraine may be permitted by the Ukraine Ministry of
Agriculture and Food and must be accompanied by a phytosanitary certificate.
2.2.3 Seeds The import of seeds (including beans) may be permitted by the Ukraine Ministry of Agriculture and
Food.
2.3 Anti-parasite products for agricultural use
2.4 Beverages, alcoholic fluids
The import of anti -parasite products for agricultural use may be permitted by the Ukraine Ministry of
Agriculture and Food.
Importation of alcohol is regulated as follows:
– for wine: 2 litres;
– for distilled spirit products: 1 litre.
2.5 Tobacco Importation of tobacco is regulated as follows: 200 cigarettes or 200 grammes of this product.
2.7 Narcotics The import of narcotics and pharmaceutical preparations and medicaments, containing narcotics, is subject to prior authorization by the Ukraine Ministry of PublicHealth.
2.8 International postal items addressed to individuals and containing electronic and emitting devices (e.g. mobile phones, smart phones, radios) that are listed in the Register of Radio-Electronic Equipment and Emitting Devices Prohibited for Use and Import to Ukraine. However, international postal items containing devices that are not listed in this register are permitted, but only if the sender/addressee has a corresponding certificate of conformity.
2.8.1 Medicaments Items containing medicines for personal use in quantities required for a course of treatment are permitted where the addressee has obtained authorization from theMinistry of Health of Ukraine.
2.11 Books, brochures, newspapers, printed matter
2.12 Foreign currency
Postal items, including EMS items, containing documents such as passports, identity cards, work permits and postage stamps (whether or not cancelled), except for organized philatelic traffic.
In accordance with the rules on the provision of the postal services approved by the Ukrainian Government on 4 October 2000, postage stamps, including envelopes bearing printed stamps,issued after 1945 and with a nominal value (according to the "Michel" catalogue) not exceeding
50 Deutsche Mark (DEM), may be sent to Ukraine in insured items.
By virtue of its domestic legislation, Ukraine now accepts the import of foreign currency in insured items addressed to natural persons, up to a maximum limit equivalent to 200 USD. It alsoaccepts the dispatch to Ukraine of foreign currency cheques made out to private individuals, up to the maximum insured value of 4000 SDR.
2.13 International postal items containing medications that are not listed in the State Register of Medicinal Products of Ukraine, including narcotic drugs, psychotropic substances and chemical precursors. However, international postal items containing medications that are not registered in Ukraine and that are intended for individual use by citizens are permitted, but only if the addressee has a corresponding letter of notification from the Ministry of Health of Ukraine.
2.15 War material The import of hunting shotguns and rifles and cartridges requires the permission of the Ukraine
Ministry of Internal Affairs.

3.5 Provisions on infringement
Customs declarations must contain all the information necessary for the application of duties, taxes and control measures on both importation and exportation. Specifically, they must state:
– the names, first names and addresses of the consignors and consignees;
– the countries of origin and of destination of the item;
– a description of the goods contained and the harmonized system code index;
– the gross weight and net weight;
– the value of the item, specifying the currency used.
In addition, certain supplementary statements on the situation of goods in respect of the customs regulations (gifts, samples, goods returned or admitted temporarily) must be made on the customs declaration.
Customs declarations constituting true declarations under Ukraine regulations, involving the liability of the consignor, must bear his handwritten signature.
Unless abuses are suspected, the customs administration exempts from the requirement to produce an invoice consignments that are non-commercial in character, irrespective of value.
The origin must be attestable for products exchanged under a preferential tariff system under agreements concluded by the European Economic Community with various countries, or under decisions of association of countries and territories dependent on certain States members of the EEC.
a Standard tax
The customs administration may subject small items addressed to private persons to a lump-sum levy when such items:
i are occasional in nature;
ii concern solely goods reserved for the personal or family use of the addressees and which, by their nature or quantity, are clearly not intended for commercial ends;
iii do not have a dutiable value of more than 5000 US dollars.
b Fiscal and customs allowances
For domestic consumption tax, this allowance is limited to: Spirits – 1 litre; wine – 2 litres; tobacco products – 200 cigarettes (or 200 g of such products per person).
Spare parts for means of transport for private use.
Importation of certain foreign goods may be subject to production of a foreign trade control document such as an import licence or an import declaration, whether stamped or not.
Ukraine legislation contains no provision relating specifically to the repression of infringements of the customs regulations applicable specially to postal items. Such infringements therefore fall withinthe scope of the general provisions of the customs laws regarding fraudulent importation and exportation.
It is a matter of principle that all goods imported into or exported from Ukraine must be declared to the
Customs and that the customs declarations must be strictly accurate.

– Preparations of vegetables, fruit, nuts or other parts of plants.
– Residues and waste from the food industries, prepared animal fodder.
Postal parcels, small packets and EMS items containing such products sent to Ukraine without the aforementioned certificate will be returned to the sender. (See also Part II, § 2.1.)
